The US Department of Defense opened its trademark licensing office in 2007, but the entertainment industry had been staking claims on names for decades. That gap became apparent when Netflix registered a trademark for "Space Force" in January 2019, eleven months before the US military established its space warfare branch under the same name.

The streaming platform's trademark application, filed for a satirical show starring Steve Carell, predates the military's December 2019 founding of the Space Force. The Pentagon never filed a trademark for the name, according to the Hollywood Reporter.

Netflix's claim is legally sound, protected by the First Amendment and fair use provisions, allowing the company to own the copyright to a fictional show while the government operates a real branch with the same name.

Potential conflicts are not unheard of in such cases. In 2011, Disney attempted to trademark "Seal Team 6" following the killing of Osama bin Laden, but abandoned the effort after public backlash.

Currently, there is no dispute. An Air Force spokesperson stated, "At this time, we are not aware of any trademark conflicts with the fictional program Space Force produced by Netflix. We wish Netflix and the show's producers the best in their creative depiction of our nation's newest branch of the military."

Why the Timing Matters

The trademark filing came as the military was still planning its space force, which was formally established in December 2019. Netflix's early move reflects how entertainment companies often secure names for potential projects, sometimes overlapping with government initiatives.

While the current situation is amicable, the precedent set by Disney's abandoned attempt shows that public opinion can influence such decisions. For now, both parties appear to be operating without friction, with the military focusing on its mission and Netflix on its creative production.
